The Fair Work Ombudsman gives employers and employees information and advice on workplace rights and obligations. The Fair Work Ombudsman website is a critical resource for employers. Before hiring a new employee, you need to make sure you know your rights and responsibilities, whether they relate to pay, minimum terms and conditions, tax or superannuation. There are many resources available on the website including the National Employment Standards (NES).
The NES lists the 11 minimum employment entitlements that have to be provided to all employees.
The national minimum wage and the NES make up the minimum entitlements for employees in Australia. An award, employment contract, enterprise agreement or other registered agreement can't provide for conditions that are less than the national minimum wage or the NES. They can’t exclude the NES.
One of the 11 minimum employment entitlements is that employers must give every new employee a copy of the Fair Work Information Statement (the FWIS) before, or as soon as possible after, they start their new job. The FWIS provides new employees with information about their conditions of employment.
Employers must also give every new casual employee a copy of the Casual Employment Information Statement at the same time.
